Purchase, Digital Content & Access Policy

1. Purpose of this Policy

This Purchase, Digital Content & Access Policy (“Purchase Policy”) governs separately purchased digital content offered through Sanctum Sound Genesis.

This Policy establishes the distinction between:

  • STREAMING ACCESS
  • MEMBERSHIP ACCESS
  • SEPARATELY PURCHASED DIGITAL CONTENT

explains:

  • Who may make purchases.
  • What a purchase does not provide.
  • Payment processing.
  • Taxes.
  • Access after purchase.
  • Refunds.
  • Fraud.
  • Rights availability.
  • Intellectual-property ownership.
  • What a digital purchase provides.
  • How purchased content is associated with an account.
  • Pricing.
  • Purchase confirmation.
  • Access after membership cancellation.
  • Chargebacks.
  • Account termination.
  • Technical availability.
  • And other rules governing digital purchases.

2. Three Different Relationships with Content

Sanctum Sound Genesis may permit users to interact with music through different forms of access.

These relationships should not be confused.

PUBLIC STREAMING

Content designated by Sanctum Sound as publicly streamable may be listened to through the Service according to the applicable access rules.

MEMBERSHIP ACCESS

Certain content or functionality may be available because a user maintains an active Sanctum Membership.

SEPARATE PURCHASE

Certain eligible tracks, albums, collections, or other digital content may be offered through an individual purchase transaction.

STREAMING IS NOT PURCHASING.
MEMBERSHIP IS NOT PURCHASING.
PURCHASING DOES NOT TRANSFER COPYRIGHT OWNERSHIP.

3. Not All Content is Purchasable

The presence of music or other content on Sanctum Sound does not mean that the content is available for separate purchase.

Sanctum Sound may determine, subject to applicable rights and agreements, which content is:

  • Publicly streamable.
  • Available through membership.
  • Separately purchasable.
  • Available through more than one of those methods.
  • Or unavailable in a particular territory or context.
  • A streaming page should not create an expectation of purchase availability unless a purchase option is actually displayed.

4. Who May Purchase

Genesis may permit:

  • REGISTERED USERS
  • PAID MEMBERS

to purchase eligible digital content.

A Guest may be required to create or sign into a Sanctum Sound account before completing a purchase.

This requirement allows Sanctum Sound to associate the purchase with an identifiable account so that:

  • The transaction can be recorded.
  • Purchase access can be maintained.
  • Receipts can be associated with the transaction.
  • Customer support can identify the purchase.
  • Refunds can be administered.
  • And the user’s entitlement can be restored where technically appropriate.

5. Guest Purchase Flow

Where a Guest selects an eligible item for purchase, the intended Genesis flow should be:

SELECT PURCHASE

CREATE ACCOUNT OR SIGN IN
↓
REVIEW PURCHASE
↓
COMPLETE PAYMENT
↓
PURCHASE ASSOCIATED WITH ACCOUNT
↓
ACCESS PURCHASED CONTENT

A Guest should not be required to purchase a recurring membership merely to buy separately purchasable content.
