DMCA / Copyright Infringement Procedure

1. Purpose of this Procedure

Sanctum Sound respects copyright and the people whose creative work gives music, visual art, photography, writing, recordings, exhibitions, and other creative expression their existence.

This DMCA / Copyright Infringement Procedure establishes the process through which copyright owners and their authorized representatives may notify Sanctum Sound of material they believe infringes their copyright.

It also establishes procedures concerning:

  • Copyright notices.
  • Review of notices.
  • Removal or disabling of access.
  • Notification of affected users where appropriate.
  • Counter-notifications.
  • Restoration of material where legally appropriate.
  • Repeat infringement.
  • Fraudulent or abusive notices.
  • Preservation of relevant records.
  • Account and membership enforcement.
  • And communication with rights holders.

This Procedure should be read together with the:

  • Copyright Policy.

2. Digital Millennium Copyright Act

The United States Digital Millennium Copyright Act, including the online-service-provider provisions of 17 U.S.C. § 512, establishes procedures through which qualifying online service providers may respond to allegations of copyright infringement.

Where the DMCA applies to Sanctum Sound and the material or activity at issue, Sanctum Sound intends to respond to legally sufficient notices and counter-notifications in accordance with applicable law.

This Procedure does not prevent Sanctum Sound from addressing copyright matters under:

  • Other applicable laws.
  • Contractual rights.
  • Licensing agreements.
  • Court orders.
  • Its Terms of Service.
  • Its Copyright Policy.
  • Or other lawful authority.

3. Designated DMCA Agent

Before public launch, Sanctum Sound should designate an agent to receive notifications of claimed copyright infringement where required for the DMCA safe-harbor framework.

The final production version of this Procedure should identify:

Sanctum Sound should also complete any registration required with the U.S. Copyright Office and maintain the accuracy and renewal of that designation as required by applicable law.

PUBLISHING AN EMAIL ADDRESS ON THE WEBSITE IS NOT, BY ITSELF, A SUBSTITUTE FOR COMPLETING ANY DESIGNATED-AGENT REGISTRATION REQUIRED BY LAW.

4. Who May Submit a Copyright Notice

A copyright infringement notice should be submitted by:

  • The copyright owner
  • A person authorized to act on behalf of the copyright owner.

A person who does not own the relevant copyright and is not authorized to represent the owner should not submit a notice purporting to exercise another person’s rights.

5. Before Submitting a Notice

Before submitting a copyright notice, the complaining party should carefully consider whether the disputed use may be:

  • Authorized.
  • Licensed.
  • Public domain.
  • Permitted by the copyright owner.
  • Protected by an applicable copyright exception or limitation.
  • Or otherwise lawful.

Copyright procedures should not be used merely because a person dislikes:

  • Criticism.
  • Commentary.
  • Competition.
  • Historical discussion.
  • Editorial treatment.
  • A lawful quotation.
  • Or another lawful use.
